Unlike many law firms that charge thousands of dollars for basic 5-6 page prenuptial agreements, most of our prenuptial and postnuptial agreements are 25-40 pages in order to make sure that we cover all the bases: your current and future assets, inheritance and gifts, business interests and licenses, debts and liabilities.

 

You can protect all of these or just some, while deciding to share the rest. For instance, some clients decide to protect only their inheritance or only their business, while many decide to protect all their current and future assets. Our prenups are tailored to your specific circumstances: spousal support or division property can vary depending on how many years you will be married before the divorce, whether you have children or not, what sacrifices either party made (such as one spouse giving up a full-time job to stay home to raise the children) and many other life events.

Regardless, our flat fee is only $1,500 to draft the prenup, and $675 to review a prenup drafted by another law firm.

We explain the law on prenups, divorces and spousal support to prevent either party from later claiming they didn't understand it. The prenups state the difference between separate property and marital/joint property with great specificity to prevent any future litigation. While there can never be a guarantee about the future, we've drafted prenuptial agreements for thousands of clients and to our knowledge, all of them were approved by judges in all the cases that resulted in divorces.

What prenuptial agreements CAN protect

  • Assets such as a home, real estate investments stock or retirement funds;

  • Gifts, inheritance and any property you may come to own in the future;

  • Business and professional practice;

  • The value of academic or professional degree (some people who get a degree during marriage are forced to pay part of its value to the spouse during divorce);

  • Any future increases in income.

  • Almost any other tangible property you may have.

What prenuptial agreements CANNOT protect

Prenuptial agreements in New York State are not allowed to regulate issues relating to the children of the marriage, in particular, custody and access issues because it must be decided based on the "child's best interests."

Prenuptial Agreements are likewise not allowed to regulate child support because the amount of child support is highly regulated.

New York State Law requires that a valid prenuptial agreement:

 

  • Is in writing;

  • Executed voluntarily;

  • Full and fair disclosure of finances at the time of execution;

  • Not unconscionable (grossly unfair);

  • It must be signed before a notary public.

Legal requirements for a prenup/postnup

It is recommended that you take at least a week to carefully go over your prenup with your attorney and your partner before signing it to make sure you understand it. It is further recommended that you wait at least a week after signing the prenup/postnup before getting married.
